Business Model & Service Structure

FYND Private Transportation ("FYND," "we," "us," or "our") operates as a technology platform connecting riders with independent contractor drivers in the Pensacola, Florida area. FYND does not employ drivers. All drivers providing transportation services through the FYND platform are independent contractors who operate their own vehicles and manage their own transportation businesses.

Similar to other rideshare and transportation network platforms, FYND facilitates connections between riders seeking pre-scheduled transportation and independent drivers offering those services. FYND provides the booking platform, payment processing infrastructure, and customer service support, while independent contractor drivers provide the actual transportation services.

Driver Status: All drivers operating through the FYND platform are independent contractors, not employees, agents, or representatives of FYND Private Transportation. Drivers maintain control over their schedules, vehicles, and business operations.

Service Provision: Transportation services are provided directly by independent contractor drivers. FYND facilitates the connection and booking process but does not directly provide transportation services.

Driver Responsibility: Each independent contractor driver is responsible for maintaining appropriate vehicle insurance, licensing, vehicle maintenance, and compliance with all applicable local, state, and federal regulations governing transportation services.

FYND utilizes Moovs, a third-party booking management platform, to facilitate ride reservations and scheduling. When you book a ride through our website or booking system, your reservation information is processed through Moovs' platform to connect you with available independent contractor drivers.

By using our booking services, you acknowledge and agree to:

• The use of third-party booking management systems
• Connection with independent contractor drivers (not FYND employees)
• The pre-scheduled nature of our service (minimum 6-hour advance booking required)

Moovs operates independently as a software service provider. For information about how Moovs handles booking data, please refer to their privacy policy and terms of service.

All payment transactions are securely processed through Stripe, a third-party payment processor. FYND does not directly collect, store, or process your payment card information. When you provide payment details during booking, this information is transmitted directly to Stripe's secure servers.

Payment Structure: Payment is collected at the time of booking to guarantee your reservation. This payment covers the transportation service provided by the independent contractor driver, as well as FYND's platform facilitation fee.

Payment Security: Stripe maintains PCI-DSS compliance and employs industry-standard security measures to protect your financial information. By completing a payment transaction through FYND, you agree to Stripe's terms of service and privacy policy.

Refunds: Refund eligibility is determined by our cancellation policy (detailed below). Approved refunds are processed through the same payment method used for the original transaction.

Advance Booking Requirement: All rides must be scheduled at least 6 hours in advance. FYND is not an on-demand transportation service. This advance scheduling allows us to match you with an available independent contractor driver and ensure reliable service.

Service Area: FYND facilitates connections with drivers serving Pensacola, Gulf Breeze, Navarre, Pace, Milton, Orange Beach (Alabama), Gulf Shores (Alabama), and surrounding areas within approximately a 35-mile radius of Pensacola. Extended trips may be available by request.

Pricing: Pricing is distance-based and schedule-based, provided upfront at the time of booking. Prices are transparent and do not include surge pricing. Payment is required in full at booking to guarantee your reservation.

Vehicle Options: Riders may select from multiple vehicle categories (FYND X, FYND Comfort, FYND XL, FYND XXL) based on availability and needs. Vehicle assignments are made by matching riders with independent contractor drivers operating appropriate vehicles.

We understand plans change. Refunds are processed according to the following schedule based on cancellation timing:

• 4+ hours before scheduled pickup: Full refund
• 2-4 hours before scheduled pickup: 50% refund
• 1-2 hours before scheduled pickup: 25% refund
• Less than 1 hour before scheduled pickup: No refund
• After driver is en route to pickup location: No refund
• After driver arrives at pickup location: No refund

Cancellations must be submitted through our booking platform or by contacting FYND directly. Refunds are processed to the original payment method within 5-7 business days.

Driver Matching: FYND makes reasonable efforts to match riders with available independent contractor drivers for scheduled rides. In the rare event no driver is available for your scheduled ride, you will receive a full refund.

Driver Substitution: If your originally assigned driver becomes unavailable due to illness, emergency, or unforeseen circumstances, FYND will attempt to assign an alternative independent contractor driver. If no substitute driver is available, you may use an alternative transportation service and submit your receipt to FYND for reimbursement consideration.

Service Standards: While drivers are independent contractors, FYND maintains service standards and expectations for drivers operating through our platform, including vehicle cleanliness, professionalism, punctuality, and customer service.

Booking Information: Information collected during booking (name, phone number, pickup/drop-off locations, dates, times) is used to facilitate your transportation service and connect you with independent contractor drivers. This information is managed through our booking platform (Moovs) and shared with your assigned driver to enable service provision.

Payment Information: Payment card details are processed exclusively through Stripe's secure infrastructure. FYND receives payment confirmation but does not access or store complete payment card information.

Communication: FYND and/or your assigned independent contractor driver may contact you regarding your reservation, pickup coordination, service updates, and transportation-related communications using the contact information you provide.

Data Usage: Your information is used solely for providing and improving our transportation facilitation services. We do not sell your personal information to third parties. For detailed information about data handling, please refer to our Privacy Policy.

Platform Service: FYND provides a technology platform connecting riders with independent contractor drivers. FYND does not provide transportation services directly.

Driver Independence: Independent contractor drivers are solely responsible for the transportation services they provide, including safe vehicle operation, route selection, vehicle maintenance, and compliance with traffic laws.

Insurance: Independent contractor drivers maintain their own vehicle insurance coverage. Riders should verify insurance coverage details with their driver if desired.

Service Disclaimer: While FYND facilitates connections and maintains service standards, we cannot guarantee specific outcomes, timing precision in all circumstances, or control all aspects of transportation provided by independent contractors. FYND makes reasonable efforts to ensure quality service but is not liable for actions, delays, or issues arising from independent contractor driver performance beyond our direct control.

Limitation of Liability: To the maximum extent permitted by law, FYND's liability for any claims arising from use of our platform or transportation services facilitated through our platform is limited to the amount paid for the specific ride in question.

By booking transportation through FYND, you agree to:

• Provide accurate pickup and drop-off location information
• Be ready at your pickup location at the scheduled time
• Treat drivers with respect and courtesy
• Comply with reasonable driver requests regarding vehicle use
• Pay all charges associated with your booking
• Not use our services for illegal purposes
• Provide accurate contact information for coordination

These platforms operate under their own terms of service and privacy policies. FYND is not responsible for the practices, policies, or operations of these third-party providers beyond our direct business relationship with them. We encourage you to review their respective terms and policies.

Governing Law: This legal notice and all services facilitated by FYND Private Transportation are governed by the laws of the State of Florida, without regard to conflict of law principles.

Jurisdiction: Any legal disputes arising from our services or this notice shall be resolved in the appropriate courts of Escambia County, Florida, or the United States District Court for the Northern District of Florida.

Service Changes: FYND reserves the right to modify, suspend, or discontinue any aspect of our platform or services at any time, with or without notice.

Notice Updates: This legal notice may be updated periodically to reflect changes in our services, business practices, or legal requirements. Material changes will be indicated by updating the "Effective Date" at the top of this notice.

Continued Use: Your continued use of FYND's platform and services following any updates to this notice constitutes acceptance of the revised terms.

By booking transportation services through the FYND platform, you acknowledge that you have read, understood, and agree to this legal notice and all terms contained herein. If you do not agree to these terms, please do not use our services.
