By accessing or using the FYND Private Transportation platform ("FYND," "we," "us," or "our"), including our website (withfynd.com), booking system, or any related services, you ("User," "Rider," "you," or "your") agree to be bound by these Terms and Conditions. If you do not agree to these terms, you may not use our services.
These Terms and Conditions constitute a legally binding agreement between you and FYND Private Transportation, operating in Pensacola, Florida.
2.1 Platform Service
FYND operates as a technology platform that connects riders with independent contractor drivers for pre-scheduled private transportation services in the Pensacola, Florida region and surrounding areas.
2.2 Not a Transportation Provider
FYND does not provide transportation services directly. All transportation services are provided by independent third-party contractors who use the FYND platform to connect with riders. FYND is not a transportation carrier and does not employ drivers.
2.3 Pre-Scheduled Service Model
FYND specializes exclusively in pre-scheduled transportation. All rides must be booked at least 6 hours in advance. FYND is not an on-demand service and does not offer immediate or last-minute ride requests.
2.4 Service Area
FYND facilitates connections with drivers serving:
Pensacola, Florida and surrounding neighborhoods
Gulf Breeze, Florida
Navarre, Florida
Pace, Florida
Milton, Florida
Pensacola Beach, Florida
Orange Beach, Alabama
Gulf Shores, Alabama
Surrounding areas within approximately 35 miles of Pensacola
Extended trips beyond the standard service area may be available by request and subject to driver availability and additional charges.
3.1 Age Requirement
You must be at least 18 years of age to book transportation services through FYND. Minors under 18 may only use our services when accompanied by a parent or legal guardian.
3.2 Account Information
You agree to provide accurate, current, and complete information when booking rides, including:
• Full legal name
• Valid phone number
• Accurate pickup and drop-off addresses
• Valid payment information
3.3 Account Security
You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to notify FYND immediately of any unauthorized use of your account.
3.4 Prohibited Users
FYND reserves the right to refuse service to anyone for any lawful reason, including but not limited to users who:
• Provide false or misleading information
• Have previously violated these Terms and Conditions
• Engage in abusive, threatening, or inappropriate behavior toward drivers or FYND staff
• Use services for illegal purposes
• Have outstanding unpaid charges or disputed chargebacks
4.1 Advance Booking Requirement
All rides must be scheduled at least 6 hours before the requested pickup time. Booking requests submitted with less than 6 hours' notice may be declined.
4.2 Booking Confirmation
Upon successful booking, you will receive confirmation via text message and/or email containing:
• Pickup date, time, and location
• Drop-off location
• Total price
• Vehicle type
• Booking reference number
4.3 Driver Assignment
FYND will assign an available independent contractor driver to your reservation. Driver information (name, vehicle details, contact information) will be provided prior to your scheduled pickup time.
4.4 Booking Modifications
Modifications to existing bookings (time changes, location changes, etc.) must be requested at least 4 hours before the scheduled pickup time. FYND will make reasonable efforts to accommodate modifications but cannot guarantee availability for changed requests.
4.5 No Guarantee of Availability
While FYND makes reasonable efforts to fulfill all booking requests, we do not guarantee driver availability for all requested times and locations. In the event no driver is available for your booking, you will receive a full refund.
5.1 Pricing Structure
Pricing is distance-based and schedule-based, calculated at the time of booking. Factors influencing price include:
• Distance between pickup and drop-off locations
• Vehicle type selected
• Time of day
• Advance notice provided
5.2 Upfront Pricing
The total price for your ride is displayed before you complete your booking. This price is final unless modifications are made to the ride details.
5.3 No Surge Pricing
FYND does not use dynamic surge pricing. Prices remain consistent regardless of demand levels.
5.4 Payment Required at Booking
Full payment is required at the time of booking to guarantee your reservation. We accept major credit cards, debit cards, and bitcoin through our payment processor, Stripe.
5.5 Payment Processing
All payments are processed through Stripe, a third-party payment processor. FYND does not store your complete payment card information. By providing payment information, you agree to Stripe's terms of service.
5.6 Additional Charges
Additional charges may apply for:
• Excessive wait time (more than 5 minutes beyond scheduled pickup time if rider is not ready)
• Additional stops not included in original booking
• Cleaning fees for damage or excessive mess left in vehicles
• Tolls, parking fees, or other travel-related expenses not included in base fare
• Extended trips beyond the standard service area
Drivers will communicate any potential additional charges before they are incurred when possible.
5.7 Tips & Gratuities
Tips are not included in the base fare and are entirely optional. If you wish to tip your driver, you may do so in cash directly or request to add a tip to your payment card charge by contacting FYND.
5.8 Commuter Pricing Programs
Regular riders who submit weekly schedules may qualify for discounted commuter pricing. Contact FYND at (850) 332-3415 to inquire about commuter programs.
6.1 Cancellation by Rider
You may cancel your booking at any time before the scheduled pickup. Refunds are processed according to the following schedule:
• 4+ hours before scheduled pickup: 100% refund
• 2-4 hours before scheduled pickup: 50% refund
• 1-2 hours before scheduled pickup: 25% refund
• Less than 1 hour before scheduled pickup: No refund
• After driver is en route to pickup location: No refund
• After driver arrives at pickup location: No refund
6.2 No-Show Policy
If you are not present at the pickup location within 5 minutes of the scheduled pickup time and cannot be reached by phone, you will be considered a no-show. No-shows are not eligible for refunds.
6.3 Cancellation by Driver or FYND
If your assigned driver or FYND cancels your ride for any reason, you will receive a full refund. In such cases, FYND will make reasonable efforts to assign an alternative driver. If no alternative driver is available, you may use another transportation service and submit your receipt to FYND for reimbursement consideration (at FYND's sole discretion).
6.4 Refund Processing
Approved refunds are processed to the original payment method within 5-7 business days.
6.5 Disputed Charges
If you dispute a charge, you must contact FYND within 7 days of the ride date. We will investigate and respond within a reasonable timeframe. Chargebacks filed without first contacting FYND may result in suspension of your account.
7.1 Punctuality
You agree to be ready at your pickup location at the scheduled time. Drivers will wait up to 5 minutes beyond the scheduled pickup time. After 5 minutes, the driver may depart, and you will be considered a no-show.
7.2 Accurate Information
You must provide accurate pickup and drop-off addresses. You are responsible for any additional charges or delays resulting from incorrect address information.
7.3 Passenger Limits
You may not exceed the passenger capacity of your selected vehicle type:
• FYND X: Up to 4 passengers
• FYND Comfort: Up to 4 passengers
• FYND XL: Up to 6 passengers
• FYND XXL: Up to 6 passengers
7.4 Prohibited Conduct
You agree not to:
• Engage in abusive, threatening, harassing, or discriminatory behavior toward drivers
• Damage vehicle property
• Smoke, vape, or use illegal substances in vehicles
• Consume alcohol in vehicles (unless explicitly permitted by driver)
• Leave excessive trash or mess in vehicles
• Bring weapons, illegal items, or hazardous materials in vehicles
• Request drivers to violate traffic laws or engage in unsafe driving
• Request drivers to exceed passenger capacity
• Use services for illegal purposes
7.5 Consequences of Prohibited Conduct
Violation of conduct policies may result in:
• Immediate termination of ride without refund
• Additional cleaning or damage fees
• Suspension or permanent ban from FYND platform
• Legal action if applicable
7.6 Children & Car Seats
Parents or guardians are responsible for providing appropriate car seats or booster seats for children as required by Florida law. Drivers are not required to provide car seats. Inform your driver in advance if you will have children requiring car seats.
7.7 Pets
Service animals are always welcome. Other pets may be permitted at the driver's discretion. You must inform FYND at the time of booking if you plan to travel with a pet (other than a service animal). Additional cleaning fees may apply.
7.8 Luggage & Belongings
You are responsible for your personal belongings. FYND and drivers are not liable for lost, stolen, or forgotten items. If you leave items in a vehicle, contact FYND immediately, and we will attempt to coordinate return with your driver. Reasonable retrieval fees may apply.
8.1 Independent Contractor Status
All drivers providing transportation through the FYND platform are independent contractors, not employees, agents, or representatives of FYND. Drivers operate their own vehicles and manage their own businesses.
8.2 Driver Responsibilities
Independent contractor drivers are responsible for:
• Maintaining valid driver's licenses and all required permits
• Maintaining appropriate vehicle insurance coverage
• Vehicle maintenance, cleanliness, and safety
• Compliance with all traffic laws and regulations
• Professional conduct and customer service
• Safe operation of their vehicles
8.3 Driver Discretion
Drivers maintain the right to:
• Refuse service to riders engaging in prohibited conduct
• Terminate rides if riders violate safety rules or behave inappropriately
• Report policy violations to FYND
8.4 FYND's Role
FYND facilitates connections between riders and drivers, processes payments, provides customer service, and maintains service standards. FYND does not control drivers' day-to-day operations, vehicle maintenance, or driving practices.
9.1 Driver Insurance
Independent contractor drivers maintain their own vehicle insurance coverage as required by law and FYND's platform standards. Insurance coverage details are the responsibility of individual drivers.
9.2 Rider Safety
For your safety:
• Always verify driver and vehicle information before entering a vehicle
• Wear seatbelts at all times
• Report any safety concerns to FYND immediately
• Do not request drivers to engage in unsafe driving practices
9.3 Emergency Situations
In the event of an accident, medical emergency, or safety threat:
• Call 911 immediately if needed
• Follow driver instructions for safety
• Report the incident to FYND as soon as safely possible
• Cooperate with law enforcement and emergency responders
9.4 Background Checks
FYND requires drivers to meet certain standards before operating on our platform. However, FYND does not guarantee the results of any background checks or screening processes and is not liable for driver actions beyond our reasonable control.
10.1 FYND Ownership
All content on the FYND platform, including but not limited to text, graphics, logos, images, software, and design, is the property of FYND Private Transportation or its licensors and is protected by copyright, trademark, and other intellectual property laws.
10.2 Limited License
FYND grants you a limited, non-exclusive, non-transferable license to access and use our platform solely for booking transportation services for personal use. You may not:
• Reproduce, distribute, or create derivative works from our content
• Use our platform for commercial purposes without authorization
• Reverse engineer or attempt to extract source code from our platform
• Use automated systems (bots, scrapers) to access our platform
10.3 Trademarks
"FYND," "FYND Private Transportation," and related logos are trademarks of FYND. You may not use these marks without our prior written permission.
11.1 Information Collection
FYND collects information necessary to facilitate transportation services, including:
• Contact information (name, phone number, email)
• Pickup and drop-off locations
• Ride history and preferences
• Payment information (processed through Stripe)
11.2 Information Usage
Your information is used to:
• Facilitate ride bookings and connect you with drivers
• Process payments
• Communicate about your rides
• Improve our services
• Comply with legal obligations
11.3 Information Sharing
We share your information with:
• Assigned drivers (to facilitate your ride)
• Payment processors (Stripe)
• Booking platform providers (Moovs)
• Law enforcement when legally required
We do not sell your personal information to third parties.
11.4 Privacy Policy

12.1 Platform "As Is"
FYND provides its platform and facilitation services "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
12.2 No Guarantee of Service
FYND does not guarantee:
• Availability of drivers for all requested times and locations
• Specific arrival times (though we make reasonable efforts to ensure punctuality)
• Uninterrupted or error-free platform operation
• Specific outcomes from transportation services
12.3 Third-Party Services
FYND is not responsible for the actions, services, or policies of third-party providers, including:
• Independent contractor drivers
• Payment processors (Stripe)
• Booking platforms (Moovs)
• Other third-party services integrated into our platform
12.4 Limitation of Liability
To the maximum extent permitted by Florida law:
FYND's total liability for any claims arising from your use of our platform or transportation services facilitated through our platform shall not exceed the amount you paid for the specific ride in question.
FYND shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
• Lost profits or revenue
• Loss of data
• Loss of business opportunities
• Personal injury or property damage (except as required by law)
• Delays or cancellations
• Actions or omissions of independent contractor drivers
12.5 Florida Law
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, the above limitations may not apply to you, and FYND's liability shall be limited to the maximum extent permitted by law.
You agree to indemnify, defend, and hold harmless FYND Private Transportation, its officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:
• Your use of the FYND platform
• Your violation of these Terms and Conditions
• Your violation of any rights of another party
• Your conduct during rides
• Any false or misleading information you provide
14.1 Informal Resolution
Before pursuing formal legal action, you agree to first contact FYND to attempt informal resolution of any disputes. Contact us at (850) 332-3415 or through our website.
14.2 Governing Law
These Terms and Conditions are governed by the laws of the State of Florida, without regard to conflict of law principles.
14.3 Jurisdiction & Venue
Any legal action arising from these Terms and Conditions or your use of FYND's services shall be brought exclusively in the state or federal courts located in Escambia County, Florida. You consent to the personal jurisdiction of these courts.
14.4 Arbitration
FYND may, at its sole discretion, elect to resolve disputes through binding arbitration in accordance with the rules of the American Arbitration Association. If arbitration is elected, it shall take place in Pensacola Florida
